We learned that OSHA fined a contractor Delaware this week for having men in a “trench” without the trench being stepped back. The dug out basement of a residential home under construction became a “trench” when the walls were poured. Basically, a basement excavation with a foundation wall is considered a trench, and any vertical dig over 4’ needs to be stepped or sloped.
We have been in contact with NAHB to obtain clarification on what the regulations are and what is required to comply. They are working to provide further clarity and help to you to deal with this, and we will advise our builder members when we hear back from them.

OSHA is in the Delaware area and may be looking at your jobs.
You should make sure all your OSHA related safety measures are in place.
Consider stepping your basement trench in the meantime.
