Land Protection Act Bill Signed by Governor Markell

The Home Builders Association of Delaware is proud to have been part of the working group that helped shape the Delaware Land Protection Act legislation, which was passed by the General Assembly in June and signed into law by Governor Markell on August 3, 2016.

The Bill, HS 1 for HB 262, removed the requirement that open space lands be considered in the decision process in County comprehensive plans, and it removed the involuntary mapping of private and public lands suitable to remain open space.  Nevertheless it contains provisions and a process for the Delaware Open Spaced Council to consider applications for lands to be designated as such.
